CALIFORNIA SUPREME COURT GRANTS ILLEGAL ALIENS THE ABILITY TO PRACTICE LAW!




“It’s An Absurdity, An Illegal Immigrant
Made An Officer Of The Court”

Greg Campbell, TPNN Political Analyst — In a unanimous ruling, the California Supreme Court ruled on Thursday that illegal aliens may practice law in California. The ruling comes as national immigration reform lingers in Congress with passage of substantive immigration reform in the near future looking unlikely.

In October, 2013, California passed legislation that would allow illegal immigrants who immigrated to this country as children the right to practice law in the state. The bill passed the legislature with broad support.

The California Supreme Court ruled on the issue of Sergio Garcia, an illegal immigrant who passed the California bar exam but has been prohibited from becoming licensed to practice law. Garcia’s case mirrors that of many illegal immigrants who have hung the balance since President Obama unilaterally decreed temporary legal status upon millions of illegal immigrants residing in the nation. Garcia does not qualify for the Deferred Action for Childhood Arrivals, the executive order that allowed immigrants under the age of 31 to live and work legally in the U.S.

The California Supreme Court conspicuously dodged creating a declarative right of illegal aliens to practice law by announcing that they would not block the legislation approved by lawmakers in September. The ruling stated, “In light of the recently enacted state legislation, we conclude that the committee’s motion to admit Garcia to the State Bar should be granted.”

“We conclude there is no state law or state public policy that would justify precluding undocumented immigrants, as a class from obtaining a law license in California,” Chief Justice Tani Cantil-Sakauye wrote for the court.

Though Garcia has worked to become a legal citizen of the U.S., the move by California is likely to rile anti-illegal immigration advocates as the California State Supreme Court has now made it possible for a lawyer to practice law while after having come to this country illegally.

California is a haven for millions of illegal immigrants. In 2011, the Department of Homeland Security reported that 2.83 million illegals resided in California. Though California is the first state to permit illegal immigrants the ability to practice law, there are similar cases awaiting rulings in New York and Florida.

Garcia was happy with the ruling and hailed the decision as a victory for those who have come to the country illegally but still want to play a role in the legal profession. “I never in my life imagined it would take me longer to win my right to practice than it took to actually get my degree,” Garcia said. “I’m glad California is moving forward and I think we’re setting a good example for the rest of the country.”

While Garcia is excited, anti-illegal immigration advocates are upset over the ruling that, seemingly, validates being in the country illegally. Mark Krikorian, the executive director at the Center for Immigration Studies, succinctly noted,
“It’s an absurdity, an illegal immigrant made an officer of the court. This is one more step toward eliminating the distinction between legal and illegal immigrants.”
